Important Note About Customer Data. This Privacy Policy does not apply to any personal information that we process on behalf of our customers through their use of our Services ("Customer Data"). Our customers' respective privacy policies govern their collection and use of Customer Data. Our processing of Customer Data is governed by our Data Processing Agreements and customer contracts, not this Privacy Policy. Any questions or requests relating to Customer Data should be directed to the relevant customer.

2. Personal Information We Collect

The categories of personal information we collect depend on how you interact with us, our Services, and the requirements of applicable law. We collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources, as described below.

A. Personal Information You Provide to Us Directly

  • Account Information. We collect personal information when you create or administer your account, such as your name, email address, phone number, company name, job title, and any other information you provide to us.
  • Subscription and Billing Information. We collect information associated with your subscription and billing, including payment details. Payment processing is handled by third-party payment processors. We do not directly collect or store payment card information, but we may receive information associated with your payment details (e.g., billing address, last four digits of payment card).

When our customers connect their messaging accounts through our platform, we collect and process information from Meta Platforms (Facebook, Instagram, WhatsApp), and other messaging services on their behalf. This information includes:

  • Messages and conversations. The content of messages exchanged between our customers and their end users through connected channels, including text, images, files, and other media shared within conversations.
  • User profile information. Names, profile pictures, and identifiers of end users who communicate with our customers through connected messaging channels.
  • Page and account data. Information about connected Facebook Pages, Instagram Business Accounts, and WhatsApp Business Accounts, including page names, account identifiers, and configuration settings.
  • Engagement data. Message delivery status, read receipts, and interaction metadata provided by the messaging platforms.

This information is collected as Customer Data on behalf of our customers who have connected these channels. We process this data solely to provide messaging and customer support services as instructed by our customers. We do not use this data for our own independent purposes, do not sell it to third parties, and do not use it for advertising. Our customers are responsible for ensuring they have appropriate legal bases and consents for processing their end users' data through our platform.

3. How We Use Your Personal Information

We use your personal information for various business purposes, including to provide our Services, for administrative purposes, and to market our products and Services.

D. Connected Messaging Platform Data

We process data from connected messaging platforms (including Facebook Messenger, Instagram Direct Messages, and WhatsApp Business) exclusively to:

  • Route conversations to the appropriate AI agent or human team member
  • Apply our customers' configured playbooks, automation rules, and business logic to conversations
  • Generate analytics and reporting about conversation volumes, resolution rates, and team performance for our customers
  • Train and improve our AI agents' ability to understand and respond to customer queries, using only the connecting customer's own conversation data and in accordance with their instructions

We do not use messaging platform data to build profiles of end users, serve advertisements, or share data with third parties other than the messaging platform provider as required to deliver messages. Data from each customer's connected channels is logically isolated and is never shared with or accessible to other customers.

4. How We Share Your Personal Information

We share your personal information with third parties for various business purposes, including to provide our Services, protect our interests, and comply with legal obligations.

A. Service Providers

We share personal information with third-party service providers who assist us in operating our Services, including:

  • Cloud hosting and infrastructure providers
  • Payment processing services
  • Email delivery and communication services
  • Analytics and monitoring services
  • Customer support platforms

B. Business Partners

  • Meta Platforms, Inc. — When customers connect Facebook Messenger, Instagram Direct Messages, or WhatsApp Business accounts, messages and delivery data are transmitted through Meta's APIs. Meta's processing of this data is governed by Meta's own Privacy Policy and Data Policy.
  • Other messaging providers. We may integrate with additional messaging platforms. Data shared with these providers is limited to what is necessary to deliver and receive messages on our customers' behalf.

We share only the minimum data required to deliver the messaging service and do not provide these platform providers with additional customer or end-user data beyond what is transmitted as part of normal message delivery.

5. Your Privacy Rights and Choices

A. Communication Preferences

Email Communications. You can opt out of marketing emails using the unsubscribe link in our emails. You will continue to receive service-related communications necessary for your account.

B. Data Subject Rights

Depending on your location, you may have certain rights regarding your personal information, including:

  • Access: Request access to your personal information
  • Rectification: Request correction of inaccurate information
  • Erasure: Request deletion of your personal information

Messaging platform data. Messages and conversation data from connected channels (Facebook Messenger, Instagram, WhatsApp) are retained for the duration of the customer's subscription and in accordance with our data retention schedule. Upon account termination, messaging data is deleted in accordance with our standard data deletion timelines unless retention is required by law. Customers may request earlier deletion of specific messaging data by contacting us at privacy@delyt.ai.

8. International Data Transfers

We may transfer personal information to countries outside your jurisdiction, including countries that may not provide the same level of data protection. When we transfer data internationally, we implement appropriate safeguards, such as Standard Contractual Clauses approved by relevant authorities.

9. Children's Privacy

Our Services are not intended for children under 16 years of age. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete such information.

10. Third-Party Links and Integrations

Our Services may contain links to third-party websites or services, and our platform integrates with third-party messaging services including those operated by Meta Platforms, Inc. (Facebook Messenger, Instagram, WhatsApp). When you use these integrated services through our platform, your data is also subject to the third-party provider's privacy practices. We are not responsible for the privacy practices or content of these third parties beyond our contractual obligations as a service provider.
